Welcome to Kuva Media's Video Testimonial Consent and Release Agreement. This document outlines the terms and conditions for participating in our video testimonials. We value your contribution and want to ensure that you understand how your testimonial may be used. This agreement covers important aspects such as the purpose of the testimonial, rights granted, social media usage, privacy considerations, and our commitment regarding AI training. Please read this document carefully before agreeing to participate.
Video Testimonial Consent and Release Agreement
By checking the "I Agree" box, you consent to the following terms for the collection, use, and distribution of video testimonials by Kuva Media ("Company"):
- Purpose: You agree to participate in a video testimonial ("Testimonial") for the Company, which may be used in whole or in part for promotional, marketing, or other lawful purposes.
- Rights Granted: You grant the Company perpetual, worldwide, royalty-free rights to use, reproduce, edit, exhibit, broadcast, distribute, and create derivative works of the Testimonial, including your image, likeness, voice, and statements in any media.
- Social Media Use: You consent to the use of your Testimonial on social media platforms (including but not limited to Facebook, Instagram, Twitter, LinkedIn, YouTube, and TikTok) for promoting the Company's services or products.
- No Compensation: You will not receive any compensation for the use of your Testimonial.
- Voluntary Participation: Your participation is voluntary. You may withdraw consent before publication by contacting us.
- Release of Claims: You release the Company, its successors, assigns, and licensees from any claims related to the use of the Testimonial.
- Privacy and Data: The Company will use the Testimonial in accordance with its Privacy Policy and applicable laws. You consent to necessary data processing as outlined in this agreement.
- Truthfulness: You confirm your statements are true and agree not to make defamatory or disparaging statements about the Company.
- No Conflict: You declare no conflict of interest in providing this Testimonial and confirm you haven't been coerced to participate.
- Governing Law: This agreement is governed by the laws of the United States.
- AI Training and Third-Party Platforms:
a) Kuva Media Commitment: Kuva Media does not use testimonials, user-generated content (UGC), or other customer content for training AI systems. Your Testimonial will be used solely as outlined in this agreement within Kuva Media's direct control.
b) Third-Party Platforms: When your Testimonial is shared on third-party platforms (such as social media networks), these platforms may have their own policies regarding the use of content for AI training or other purposes. Kuva Media cannot control or guarantee how these platforms may use your content.
c) Acknowledgment: By agreeing to this clause, you acknowledge that while Kuva Media will not use your content for AI training, third-party platforms where the content is shared may have different practices. You accept that sharing your Testimonial on these platforms is subject to their respective terms of service and privacy policies.
d) Opt-Out Option: If you wish to limit the potential use of your Testimonial by third-party platforms for AI training or similar purposes, you may request that Kuva Media only use your Testimonial on platforms and in ways that do not involve sharing on social media or other third-party sites. Please contact us to discuss this option. - Age Requirement: You confirm that you are at least 18 years old.
- Modification: The Company reserves the right to modify this agreement. Any changes will be effective upon posting of the revised agreement, and your continued participation constitutes acceptance of the modifications.
- Severability: If any provision of this agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Electronic Signature: By checking the "I Agree" box, you consent to the use of electronic signatures for this agreement, which shall have the same legal effect as a handwritten signature.
- Entire Agreement: This agreement constitutes the entire understanding between you and the Company regarding the use of your video testimonial.
By checking the "I Agree" box, you confirm that you have read, understood, and agree to these terms. You acknowledge that you've had the opportunity to review the Company's Privacy Policy and Terms of Use.
